Terms of use — Ghisa Pro app
The Ghisa Pro app, for people who train.
Italiano · English · Español · Français · Deutsch · Nederlands · Polski · Português (Brasil) · Português (Portugal) · 日本語
These are the rules for using the Ghisa Pro app. By using the app you accept them. How we handle your data is explained in the app privacy notice.
1. Who provides the app
Ghisa Pro is provided by Viola Fabrizio, sole proprietorship, VAT number (partita IVA) 03959520929, registered office at Via Petrarca 24/E1, 09017 Sant'Antioco (SU), REA CA-352250. The other details are in the Legal notice.
2. What it is, and what it isn't
Ghisa Pro helps you organize weight training: it builds programs, logs sets, calculates reference weights and estimates your calorie needs.
It is not a medical device. It doesn't diagnose, treat, prevent or monitor any disease. Weights, reps, calories and macronutrients are estimates built on general parameters and on what you enter: they are not medical advice and don't replace a doctor, a physiotherapist or a nutritionist.
Before starting a program, or changing your diet, talk to a doctor, especially if you have a health condition, take medication, have had injuries or are pregnant. If you feel pain during an exercise, stop. Weight training carries a risk of injury that no app can remove.
3. Who can use it
You must be at least 16 years old. You need a personal account, with true details; it can't be shared or transferred. Keep the email inbox you sign in with protected, and let us know if you think someone is using your account. To use the app you must consent to the processing of health data described in the privacy notice.
4. How much it costs
In the browser (app.ghisapro.com) the app is free, with no ads and no purchases.
In the iPhone (App Store) and Android (Google Play) apps there are the trial, the free plan with ads and the subscription. The features are the same in all three — programs, workouts, nutrition, career, Ghisa Points, friends, gyms —: the only difference is whether you see ads.
The trial. For 30 days from sign-up you use the app with no ads and without paying (people who were already registered when the plans started get 30 days from that day). The trial doesn't ask for a card and no charge starts at the end: you automatically move to the free plan with ads.
Free with ads. After the trial the app stays free and occasionally shows a full-screen Google AdMob ad, only when you enter a section and with frequency limits: never during a workout, with a timer running or in Settings. Under 18, ads are non-personalized only. How data is processed for ads, and how you choose between personalized and non-personalized ads, is explained in the privacy notice, in paragraph 7b.
The ad-free subscription.
- What it gives you: it removes ads on all devices where you sign in with the same account. It doesn't unlock other features.
- Price: there are two subscriptions, Monthly and Yearly. The price is the one shown on the App Store or Google Play and on the app's “Your plan” page before purchase, VAT included, in your country's currency. The price that applies is the one the store shows you on the payment screen, before you confirm.
- How you pay: only inside the app, with the App Store (on iPhone) or Google Play (on Android) payment system and the methods the store offers you. The payment is collected by the store, which sends you the receipt; the app and the service are provided by us.
- Automatic renewal: the subscription renews by itself at the end of each period (one month or one year), charging the same amount, until you cancel it. There's no minimum term beyond the period you've paid for.
- If you subscribe during the trial: the subscription starts right away, with the first charge; the remaining trial days are not added.
- Cancellation: whenever you want, from the subscription settings of the App Store (on iPhone) or Google Play (on Android). From the app you get there via Settings → Your plan → “Manage subscription”. To avoid paying for the next period, cancel before the renewal date. After cancelling you stay ad-free until the end of the period already paid, then you go back to the free plan with ads. Deleting your account does not cancel the subscription: it has to be cancelled from the store.
- Refunds: payments are refunded by the store, according to its rules. For the App Store, requests are made at reportaproblem.apple.com; for Google Play, through the Google Play refund procedure. If you cancel, the remaining part of the period isn't refunded, except for withdrawal below, the cases provided for by law and the store's rules.
- Price changes: if we change the price of an ongoing subscription, the store notifies you in advance and, where its rules require it, asks you to accept it. You can always cancel before the new price applies.
The 14-day right of withdrawal. If you're a consumer, you can withdraw from the subscription within 14 days of purchase, without giving reasons. The subscription is sold to you by the store, which also handles withdrawal and refunds, according to its terms: for the App Store, requests are made at reportaproblem.apple.com, for Google Play through the Google Play refund procedure (see “Refunds”).
Conformity and updates. Digital content and services are covered by the legal guarantee of conformity of the Consumer Code (Codice del consumo, arts. 135-octies et seq.): if the subscription doesn't do what it promises, you're entitled to have it brought into conformity and, if that isn't possible, to a price reduction or to terminate the contract. We provide the app updates, including security updates, needed to keep it in conformity for the whole duration of the subscription. To use it you need an account, an iPhone or Android phone with the system version shown on the store page, and a connection to sign in and sync (after the first sign-in it largely works offline too).
The gift. We may give the app as a gift, for a period or with no end date, at our discretion: it's a gift, not a right, and it can't be converted into money. When it ends you go back to where you were (trial, subscription or ads). The gift doesn't stop a subscription you already have with the store: if you want, cancel it yourself.
Ghisa Points and medals of the year. The app awards points (Ghisa Points) for use, completed workouts, consistency and published programs, within the limits written in the guide inside the app, and shows them on a leaderboard, on any plan. On 1 January each year the top three on the leaderboard of the year just ended receive a medal (gold, silver, bronze) shown in the app next to their nickname, on the leaderboard and in their profile for the whole following year, until the new winners; in case of a tie, whoever reached the points first wins. The medal is a recognition: it has no economic value, can't be converted into money, can't be transferred and gives no right to goods or services. Points are not currency, have no economic value and can't be transferred; we may change the rules for awarding them in the future by giving notice in the app. If a user earned points by cheating, we may revoke the medal, with the reason recorded.
5. Your content
The programs, exercises, notes and profile photo remain yours. When you share a program with a friend, with your gym or in the public list, you authorize us to show it to the people you chose, solely for the app to work.
Nickname and profile photo are seen by the friends you link, the gyms you give access to and, if you publish a program, all registered users. They must not impersonate another person or a brand, or be offensive or vulgar.
Public programs are seen by all registered users, with your nickname, your photo, the votes and the downloads. By publishing, you declare that the content is yours or that you're allowed to publish it. In the program and in the notes don't write:
- illegal, offensive, violent or sexually explicit content, or content inciting hatred;
- other people's personal data, phone numbers, addresses or links to external sites;
- advertising, promotions or references to products and services;
- instructions presented as treatments or medical advice, or the use of drugs and banned substances;
- copied content you don't hold the rights to.
It's also not allowed to use the social features to harass someone, manipulate votes and downloads (for example with multiple accounts), obtain Ghisa Points by artificial means (multiple accounts, workouts or opens declared but not done, automated programs), try to read other people's data, get around the protections, overload the service or extract the catalog by automated means.
The exercise catalog (descriptions, notes, photos, videos) is ours or used under license: you can use it in the app, but not copy, republish or resell it.
6. Reports and moderation
How to report. Every public program has the “Report this program” button: choose or write the reason (a nickname is needed; if you report the same program again, the report is updated). For any other content, or if you don't use the app, write to info@ghisapro.com saying what, where and why you consider it illegal. If the report arrives by email, we confirm that we've received it and tell you by email what we decided. Every decision — withdrawing the program or rejecting the report — is recorded together with the report, with the reason and the date. If the report comes from the app, today the app can't reply to you yet: we'll tell you the decision if you write to us at info@ghisapro.com indicating the program; when the app has a notice for this, it will arrive there.
How we decide. We examine every report in a timely, diligent and non-arbitrary manner, without automated tools: decisions are made by a person. If a report is well-founded, we may remove the program from the public list, ask for the nickname or photo to be changed, or in serious cases suspend the account.
The statement of reasons. When we remove your content or restrict your account, we write to you, at your account's email address, what we did, why (the rule or law violated, and the facts; the reason stays recorded with the program) and how to contest it: reply to info@ghisapro.com and we'll review the decision. In any case you can turn to a certified out-of-court dispute settlement body or to the courts. This is what articles 16 and 17 of Regulation (EU) 2022/2065 (Digital Services Act) provide.
Anyone who repeatedly sends manifestly unfounded reports may have the ability to report suspended for a period, after a warning.
7. Point of contact
The single point of contact for users and for the authorities of the Member States, the European Commission and the European Board for Digital Services (arts. 11 and 12 of Regulation (EU) 2022/2065) is info@ghisapro.com. You can write in Italian or English.
8. Suspension and closure of the account
We may suspend or close an account that breaks these rules seriously or repeatedly, normally after a warning; without warning only in serious cases (illegal content, compromised account, request from an authority). We tell you, with the reason, as in point 6. For Ghisa Points obtained by artificial means we may first reverse the points or suspend their counting (you're left out of the leaderboard, the app keeps working): these actions too are recorded with the reason and you can see them in the Points breakdown.
You can stop whenever you want: Settings → Account → “Delete account and data”. It's immediate and permanent; before that, if you want, export your data (Settings → Backup). If you have a subscription, cancel it from the store: deleting the account doesn't stop it. Without the app, follow the Deleting your account page.
We may shut down the service with reasonable notice, leaving you time to export your data. If you have a subscription running, we'll refund the part of the period you won't be able to use.
9. Availability
We do our best to keep the app working, but we don't promise it will always be available and error-free. Make a backup of your data from time to time. We may change, add or remove features, for technical, security or legal reasons or because of the stores' rules, or to improve the app; if a change makes what you use much worse, we'll tell you first. If it makes what the subscription gives you worse in a non-negligible way, we'll write to you by email before it takes effect and you can withdraw within 30 days, with a refund of the unused part of the period. A version of the app that's no longer supported may stop working until you update it from the store: your data stays.
Notifications (only in the iPhone and Android apps, if you allow them) are a help: they depend on the phone, the network and Apple's and Google's notification services, and may arrive late or not at all. For expiry dates, installments and classes, what you see in the app and what your gym tells you is what counts. Service notifications (trial, subscription, gift, app versions, prices and terms) can't be turned off one by one, only by turning off all notifications; those about news and offers arrive only if you turn them on yourself. You choose them in Settings → Notifications, and the privacy notice explains what data they use.
10. Liability
We are liable for damage caused intentionally or by gross negligence and, in any case, for personal injury: on this the law allows no limitation. We are not liable for injuries due to training, for decisions made on the app's indications without talking to a doctor, for content published by other users or by your gym, or for loss of data due to failures of our providers or of your device.
If you're a consumer, no clause takes away the rights the law gives you.
11. Changes
If we change these terms, we'll tell you in the app before they take effect. If you don't accept them, you can stop using the app, cancel the subscription and delete the account. For prices, point 4 applies.
12. Applicable law
Italian law applies. If you're a consumer, you keep the mandatory protections of the law of the country where you live and can go to the court of your place of residence. We don't adhere to an alternative dispute resolution body: for a complaint write to info@ghisapro.com, and you remain free to turn to a body of this kind or to the courts.
